TUNING DISCLAIMER This Tuning Disclaimer explains the most important risks of ECU tuning and your responsibilities before and after you use Flow VIN Tune (part of the Flow.VIN ecosystem) ("Flow VIN Tune", "we", "us") and our AI-assisted, human-approved ECU tuning service (the "Service"). Please read it in full. It applies to every file we make available to you (each a "Delivered File"), and it forms part of, and should be read together with, our Terms of Service, Privacy Policy, and AI Disclosure. 1. READ THIS FIRST ECU TUNING IS A PERFORMANCE MODIFICATION THAT CARRIES REAL AND SERIOUS RISKS. INSTALLING A MODIFIED CALIBRATION ON YOUR VEHICLE CAN DAMAGE THE ENGINE, TURBOCHARGER, TRANSMISSION, DRIVETRAIN, OR OTHER COMPONENTS AND SYSTEMS, AND CAN AFFECT THE RELIABILITY, DURABILITY, AND DRIVABILITY OF YOUR VEHICLE. TUNING INCREASES STRESS ON MECHANICAL PARTS. IT CAN EXPOSE, TRIGGER, OR WORSEN A PRE-EXISTING, LATENT, OR UNKNOWN FAULT OR WEAKNESS IN YOUR VEHICLE, WHICH MAY ULTIMATELY LEAD TO COMPONENT OR ENGINE FAILURE. YOU PROCEED AT YOUR OWN RISK. WE DO NOT AND CANNOT GUARANTEE ANY RESULT. WE MAKE NO REPRESENTATION OR WARRANTY THAT ANY TUNE IS "SAFE", "GUARANTEED", OR "WARRANTY-SAFE", THAT IT WILL ACHIEVE ANY PARTICULAR POWER, TORQUE, FUEL-ECONOMY, OR OTHER FIGURE, OR THAT IT IS FIT FOR ANY PARTICULAR PURPOSE. ACTUAL RESULTS DEPEND ON FACTORS OUTSIDE OUR CONTROL, INCLUDING YOUR VEHICLE'S CONDITION, FUEL, MAINTENANCE, ENVIRONMENT, AND HOW THE VEHICLE IS USED. These limitations on performance and results are a specific deviation from what you might otherwise expect, and you accept them separately and actively when you confirm the consent and disclaimer before submission and before download. They do not affect your statutory rights described in Section 10. 2. YOUR RESPONSIBILITY FOR THE VEHICLE'S CONDITION YOU ARE RESPONSIBLE FOR ENSURING THAT YOUR VEHICLE IS IN SOUND MECHANICAL CONDITION AND IS CORRECTLY MAINTAINED AND SERVICED, AND THAT IT HAS NO UNDERLYING FAULT, BEFORE YOU INSTALL ANY DELIVERED FILE. Tuning a vehicle that is worn, faulty, poorly maintained, or out of service interval significantly increases the risk of damage. If you are in any doubt about the condition of your vehicle, have it inspected by a qualified professional before proceeding. 3. ROAD-USE LEGALITY AND TYPE APPROVAL WHETHER A TUNED VEHICLE MAY LAWFULLY BE USED ON PUBLIC ROADS VARIES BY COUNTRY, STATE, AND REGION, AND IS YOUR RESPONSIBILITY. Tuning typically changes performance values that are not covered by the vehicle's original type approval. As a result, in some countries the vehicle's operating permit or registration can be affected, and an inspection, re-approval, or other administrative step may be required before the vehicle may be used on public roads. For example, in Germany a modification of this kind can cause the vehicle's general operating permit to lapse until the vehicle has been individually inspected and re-approved. In the United States, on-road use may be restricted under federal and state law, and in California a non-OEM ECU calibration generally requires a CARB Executive Order to be street-legal and may fail emissions inspection without one. We make no claim that any modification meets these or any other requirements. Equivalent or different rules apply in other jurisdictions. It is your duty to determine what applies where you drive and register the vehicle, and to obtain any required inspection, approval, or registration before road use. 4. MANUFACTURER AND DEALER WARRANTY MODIFYING YOUR VEHICLE'S ECU MAY CAUSE THE VEHICLE MANUFACTURER OR A DEALER TO DENY WARRANTY COVERAGE FOR YOUR VEHICLE. You are responsible for understanding how a modification may affect any warranty, service plan, or goodwill arrangement that applies to your vehicle. We make no "warranty-safe" claim and give no assurance that any warranty will remain in force. 5. WHAT THE SERVICE DOES AND DOES NOT DO Flow VIN Tune provides Stage 1 and Stage 1+ calibrations only, on supported ECU families. THE SERVICE DOES NOT MODIFY, DISABLE, BYPASS, OR DEFEAT ANY EMISSIONS-CONTROL DEVICE OR FUNCTION, AND DOES NOT PRODUCE ANY DEFEAT DEVICE. This includes diagnostic systems, oxygen, NOx, or particulate sensors, the diesel particulate filter (DPF), exhaust gas recirculation (EGR), selective catalytic reduction (SCR), and catalytic converters. It does not provide Stage 2. We make no claim that any modification is legal, emissions-compliant, or type-approved under any emissions or other regulatory scheme. 6. HUMAN APPROVAL REDUCES BUT DOES NOT ELIMINATE RISK Every file is reviewed and explicitly approved by a human tuner before it can be made available to you, and no file is delivered automatically. Human review is a quality and eligibility step that reduces risk. IT DOES NOT ELIMINATE RISK, AND IT IS NOT A WARRANTY OR A REPRESENTATION THAT A DELIVERED FILE IS SAFE, FIT FOR YOUR VEHICLE, ROAD-LEGAL, OR FREE FROM THE POSSIBILITY OF DAMAGE. Where a Delivered File is produced on a supported ECU family it is proposed with AI assistance and approved by a human tuner; some files may be prepared by a human tuner without an AI candidate. In every case a human tuner approves the file before it can be made available to you, and the outcome is not guaranteed. The AI Disclosure explains how this works. 7. INTENDED USE, JURISDICTION, AND YOUR RESPONSIBILITY At intake we record your stated intended use and jurisdiction for the order. Recording this information helps us provide the Service; it does not transfer responsibility to us and it is not advice that any use is lawful. YOU ARE SOLELY RESPONSIBLE FOR CONFIRMING THAT INSTALLING AND USING ANY DELIVERED FILE FOR YOUR ORDER IS LAWFUL WHERE YOU DRIVE AND REGISTER THE VEHICLE, FOR YOUR INTENDED USE, FOR USING THE VEHICLE ACCORDINGLY, AND FOR COMPLYING WITH ANY DISCLOSURE OR NOTIFICATION OBLIGATIONS THAT APPLY TO YOU. You also confirm that you own the vehicle or are authorised to have it tuned. 8. REVERT TO STOCK We retain a copy of your Original File in write-once storage so that, while we hold it, you can request a revert to factory calibration through the support options in your account. Reverting to stock does not undo any physical damage, legal consequence, or other effect that may already have occurred. Revert to stock is available as a good-faith remedy in addition to, and without affecting, your statutory rights under Section 10. 9. LIABILITY Your use of any Delivered File is at your own risk. OUR LIABILITY TO YOU IS LIMITED AS SET OUT IN THE TERMS OF SERVICE, WHICH PROVIDE A CAP ON OUR LIABILITY TOGETHER WITH CARVE-OUTS FOR LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED. NOTHING IN THIS TUNING DISCLAIMER OR IN THE TERMS OF SERVICE LIMITS OR EXCLUDES OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FOR FRAUD, FOR INTENT OR GROSS NEGLIGENCE, OR FOR ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW. WHERE WE BREACH AN ESSENTIAL CONTRACTUAL OBLIGATION, OUR LIABILITY IS NOT EXCLUDED BUT IS LIMITED TO FORESEEABLE, CONTRACT-TYPICAL DAMAGE. YOUR MANDATORY STATUTORY CONSUMER RIGHTS, INCLUDING ANY RIGHTS UNDER DIRECTIVE (EU) 2019/770 ON THE SUPPLY OF DIGITAL CONTENT, ARE UNAFFECTED BY ANY CAP. If a Delivered File does not conform to what was agreed, you keep your statutory remedies under applicable consumer law, including, in the EU and EEA, the right to have it brought into conformity free of charge, a price reduction, or to end the contract. 10. YOUR STATUTORY RIGHTS Nothing in this Tuning Disclaimer limits or affects any mandatory rights you have as a consumer that cannot be excluded or limited under the law of your country of residence, including any statutory rights you have in respect of digital content. The performance and result limitations in this Tuning Disclaimer do not affect those rights. This Tuning Disclaimer applies to the fullest extent permitted by applicable law and does not reduce those rights.
